To protect the rights of our members, the law firm of Fogel, Keating, Wagner, Polidori and Shafner has recommended that the following steps be taken any time a member is involved in a workmen's compensation case:
 
1. Request and obtain copies of your medical records when they are generated.  Doctors generate reports for every visit.  Obtaining copies for your review is the only way to make certain that your medical records reflect all of the symptoms you have reported.
 
2.  If possible, provide your doctor with a copy of the "body diagram" at the time of your first visit and ALWAYS provide a copy of the "body diagram" any time your symptoms change significantly (keep a copy for yourself, as well).  Fill the chart out, date it and ask that the document be placed in your file.  If the doctor refuses to place it in your file, then insist that your doctor date and initial the diagram.
 
3.  Make sure your doctor understands, early on, that you expect to be part of any substantive conversation the doctor has with your workers' compensation insurance carrier and/or employer regarding your claim.
