What is Fair Share?

 

By Aurora City Charter, The Aurora Police Association is the recognized collective bargaining agent for the Aurora Police bargaining unit. Every sworn member from Captain down to Officer is a member of the bargaining unit, whether they are a member of the APA, the FOP, or neither organization. Although the APA does all the negotiating, management and maintenance of the contract, every member of the bargaining unit benefits from this. For that reason the APA negotiated “Fair Share” into the contract. As the name implies, it’s only fair that every member of the bargaining unit, not just the members of the APA, should pay their share of the costs associated with the contract.

 

Is Fair Share unique to Aurora?

 

By no means. Fair Share is a common clause in contracts throughout the United States. Many other departments, such as Denver and Broomfield, have Fair Share clauses in their contracts. The Denver Sheriff's Department, which is represented by FOP Lodge 27, has a Fair Share clause in their contract requiring non-FOP members to pay Fair Share.

 

Do I have to pay Fair Share?

 

Yes. Article 2, section 4 of the the contract makes payment of Fair Share a condition of employment for all members of the bargaining unit. APA members pay their portion of Fair Share through their monthly dues. The FOP has declined to collect Fair Share as part of their dues and leaves payment up to each individual member. Those that are not members of either organization are also responsible for paying Fair Share on their own.

 

What if I don’t agree with the amount?

 

Although the contract does not provide a specific means of calculating Fair Share, the respective presidents of the APA and the FOP agreed upon a means of determining that amount. That agreement can be seen here. If a member of the bargaining unit wishes to appeal the Fair Share amount, that member must follow this process. It is important to note that, while a member may appeal the Fair Share amount, they must continue to pay Fair Share during the appeal process.

 

What if I just refuse to pay?

 

As stated earlier, payment of Fair Share is a condition of employment. While the APA would much rather that you voluntarily pay what is owed, refusal to pay could result in your termination for failing to comply with a condition of your employment as a member of the Aurora Police Department.
